KAJAHKURAG LTD ("BlinkHost") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), the text of which may be found on the U.S. Copyright Office website, we will respond expeditiously to claims of copyright infringement committed using the BlinkHost service.
1. The "Safe Harbor" Statement
BlinkHost is a Platform-as-a-Service (PaaS) provider. We host content at the direction of our users. We do not proactively monitor or curate the content uploaded to our Edge Servers.
As such, under the DMCA, Nigerian Copyright Law, and similar international safe-harbor frameworks, KajahkuraG Ltd is not liable for copyright infringement by our users, provided we promptly remove or disable access to the infringing material upon notice.
2. Reporting Copyright Infringement (The "Takedown Notice")
If you are a copyright owner (or authorized to act on behalf of one) and believe that your work has been copied in a way that constitutes copyright infringement, please submit a DMCA Notice to our Designated Copyright Agent.
Your Notice MUST include the following:
- Identification of the Work: A description of the copyrighted work you claim has been infringed (e.g., "The original design of my agency website located at [Original URL]").
- Identification of the Infringing Material: The specific URL(s) on BlinkHost (e.g., https://bad-user.blinkhost.me or https://clients.agency.com) that you want removed.
- Contact Information: Your address, telephone number, and email address.
- Statement of Good Faith: A statement that you have a "good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law."
- Statement of Accuracy: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
- Signature: A physical or electronic signature of the copyright owner or authorized agent.

3. Our Response & "Site Lock" Protocol
Upon receipt of a valid DMCA Notice, BlinkHost will:
- Verify: We check that the notice is complete and valid.
- Action: We will immediately disable access to the allegedly infringing material.
- Notify: We will make a reasonable attempt to contact the alleged infringer (our user) and provide them with a copy of your DMCA Notice.
Technical Note: This is achieved via our "Site Lock" mechanism, which forces the Edge Server to return a 404 error immediately.
4. Counter-Notice (The "Appeal")
If you are a BlinkHost user and your site was locked due to a mistake or misidentification, you may file a Counter-Notice.
Your Counter-Notice MUST include:
- Identification: The URL(s) of the material that was removed or locked.
- Statement of Consent: A statement that you consent to the jurisdiction of the Federal High Court in Nigeria (or the jurisdiction where the copyright claimant is located) and that you will accept service of process from the person who provided the original DMCA notification.
- Statement of Good Faith: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Signature: Your physical or electronic signature.
Effect of Counter-Notice: If we receive a valid Counter-Notice, we may restore the material in 10-14 business days unless the original complaining party notifies us that they have filed a court action to restrain you from infringing activity.
5. Repeat Infringer Policy
BlinkHost adopts a strict "Three Strikes" policy.
Strike 1
Site locked; user warned.
Strike 2
Account suspended for 30 days.
Strike 3: Permanent Termination
The user is banned from the platform, and all data (including "Sticky Data" and backups) is permanently purged.
We reserve the right to terminate any account immediately, without a warning strike, for egregious or blatant infringement (e.g., hosting a warez/piracy index).
