Terms of Service

1. Introduction and Acceptance

These Terms of Service ("Terms") constitute a legally binding agreement between KAJAHKURAG LTD (trading as "BlinkHost," "we," "us," or "our"), a limited liability company incorporated under the laws of the Federal Republic of Nigeria, and you ("User," "you," or "Customer").

By accessing the BlinkHost dashboard, deploying code to our Edge Servers, or paying for a subscription, you expressly agree to be bound by these Terms.

If you are entering into this agreement on behalf of a company or other legal entity, you represent that you have the authority to bind that entity.

These Terms incorporate by reference our Acceptable Use Policy (AUP), Privacy Policy, and Copyright & DMCA Policy, each of which forms an integral part of this Agreement.

In the event of a conflict, these Terms shall control unless otherwise stated.

IF YOU DO NOT AGREE, DO NOT USE THE SERVICE.

2. Service Description & "Beta" Disclaimer

BlinkHost is a Platform-as-a-Service (PaaS) that provides infrastructure for hosting static websites and web prototypes. The Service includes:

• The Dashboard: An interface for managing sites and domains.
• The Edge Runtime: A high-performance server (Rust-based) that delivers content.
• Storage: Database and file storage for your content.

Manual Fulfillment Notice: You acknowledge that certain premium features (e.g., upgrading to "Pro" or "Enterprise") currently require manual activation by our administration team.

While we strive for instant activation, you agree that a delay of up to 24 hours for account upgrades is reasonable and does not constitute a breach of contract or service failure.

3. Eligibility and Account Security

Age Requirement: You must be at least 18 years old to create an account and enter into this contract.

Individuals between the ages of 13 and 17 ("Minors") may only use the Service as an Authorized User under the direct supervision of a parent or legal guardian who owns the account.

The Account Owner is fully liable for all actions taken by the Minor.

Security: You are responsible for safeguarding your login credentials (including GitHub tokens or API keys).

We are not liable for any loss resulting from unauthorized access to your account.

4. User Generated Content (UGC) & Licensing

Ownership: You retain 100% ownership of the code, text, images, and other data ("Content") you upload to BlinkHost.

We do not claim intellectual property rights over your Content.

License to Host: By uploading Content, you grant KajahkuraG Ltd a worldwide, non-exclusive, royalty-free license to use, reproduce, host, and display your Content solely for the purpose of providing the Service.

Service Improvement (AI Clause): You grant us permission to process your code specifically for the purpose of providing automated features, such as AI-driven code reviews, performance analysis, and accessibility checks, as documented in our product documentation.

We will not sell your proprietary code to third parties.

5. Acceptable Use Policy (The "Red Lines")

BlinkHost utilizes a largely immutable deployment architecture. However, we reserve the right to immediately terminate your account and permanently disable or delete affected services and content if you violate these rules.

You strictly agree NOT to:

• Host Malware/Phishing: Hosting deceptive pages, banking trojans, or malicious scripts.
• Illegal Content: Hosting child sexual abuse material (CSAM), non-consensual sexual imagery, or content that promotes terrorism.
• Network Abuse: Using our infrastructure to launch DDoS attacks, crypto-mining scripts, or excessive bot traffic.
• Reverse Engineering: Attempting to decompile our Rust Edge binaries or probe our internal Docker network.

Enforcement: Nothing in these Terms creates an obligation for us to monitor content.

However, upon receiving a credible abuse report or otherwise becoming aware of content that may violate these Terms or applicable law, we reserve the right, in our sole discretion, to restrict, suspend, or remove such content without prior notice.

We may suspend or terminate your account at any time for violations of these Terms or the AUP.

Upon termination, access to the Service will cease, and data handling will follow our retention and deletion policies.

6. Payment, Upgrades, and "No Refund" Policy

Fees: Services are billed in advance.

No Refunds: As BlinkHost offers digital infrastructure services that incur immediate costs (server allocation, storage fees) upon activation, ALL PAYMENTS ARE NON-REFUNDABLE, except where required by applicable law.

Downgrades & "Sticky Data": Upon downgrade, certain premium configuration data may be retained in a dormant state solely to enable account restoration and continuity of service.

Such data is not actively processed and may be permanently deleted after twelve (12) consecutive months of inactivity or free-tier usage.

You may request deletion of dormant data at any time, subject to legal and operational requirements.

8. Data Processing & International Transfer

You acknowledge that KajahkuraG Ltd is a Nigerian entity, but your data is processed and stored in data centers located globally (including the UK, EU, and US) via our third-party providers.

By using the Service, you consent to the transfer of your data outside of Nigeria.

9. Governing Law and Dispute Resolution

Governing Law: These Terms shall be governed by the laws of the Federal Republic of Nigeria.

Dispute Resolution: Any dispute arising under this Agreement shall first be resolved through amicable negotiation.

If unresolved after 30 days, the dispute shall be referred to arbitration in Lagos or Ebonyi State, Nigeria, in accordance with the Arbitration and Conciliation Act.

Class Action Waiver: You agree to resolve disputes on an individual basis and waive any right to participate in a class action lawsuit.

10. Modifications

We may update these Terms at any time. Continued use of BlinkHost after an update constitutes acceptance.

It is your responsibility to check these Terms periodically.
